Your agreement with Verity
Verity Journeys LLC, a Florida limited liability company, arranges and sells travel services through its Verity Italy brand. References to “Verity,” “we,” “our,” or “us” mean Verity Journeys LLC.
Your agreement consists of these terms, your completed booking details, the accepted itinerary and inclusions, and any special conditions or supplier terms provided and expressly accepted before the relevant purchase.
A specifically accepted booking condition takes precedence over a general provision concerning the same subject. Mandatory law takes precedence over conflicting contractual provisions.
A group organizer’s acceptance does not release another adult’s personal claims without legally valid authority.
02
Verity’s role and independent suppliers
Verity plans, coordinates, arranges, and sells travel packages and individual travel services. Depending on the booking, services may include itinerary planning, reservations, accommodation, transportation, guided touring, and traveler support.
You contract with Verity for the arrangements and obligations expressly described in your booking confirmation. Paying Verity directly does not mean Verity owns or operates every service included in your trip.
Hotels, airlines, local ground operators, guides, transportation companies, restaurants, and other service providers generally operate independently of Verity.
Where Verity acts specifically as a booking agent for a service, that role and the applicable supplier conditions will be disclosed before purchase. Verity’s responsibilities otherwise follow its actual role, its express commitments, and applicable law.
To the extent permitted by law, Verity is not responsible for losses caused solely by an independent supplier’s acts, omissions, insolvency, or failure to perform. This does not eliminate Verity’s own contractual obligations or duties that cannot legally be excluded.
03
Reservations and confirmation
Reservations are subject to availability and written confirmation.
A booking is confirmed when Verity accepts the registration, receives the required cleared payment, and issues written confirmation of the reserved arrangements.
A payment receipt alone does not confirm supplier availability or guarantee a departure.
If Verity cannot confirm the requested arrangements, you may accept an offered alternative or receive a refund of payments for the unconfirmed services. Any separately authorized planning work is chargeable only under conditions disclosed and accepted before that work begins.
Do not purchase nonrefundable flights or other independent arrangements until Verity confirms the departure and applicable arrival and departure requirements.
04
Deposits and final payment
Unless a different amount is expressly stated in your accepted booking confirmation, deposits are:
The applicable category will be identified before payment.
The deposit forms part of the total tour price and is credited toward that price. It is not an additional amount charged on top of the advertised or confirmed tour price.
Once the booking is confirmed, the deposit is nonrefundable for traveler cancellations, subject to the exceptions in this agreement and applicable law. It compensates Verity for reservation handling, booking administration, coordination, and commitments undertaken for the booking.
The deposit includes compensation for Verity’s reservation handling, booking administration, itinerary coordination, and other booking services actually performed. For a confirmed booking canceled under section 12, the deposit may be retained to the extent it represents those disclosed and accepted services already performed, subject to applicable law. The same services or supplier costs will not be charged twice. This does not change the full-refund obligation for commercial cancellations under section 11.
The remaining balance is due no later than 60 calendar days before departure, unless an earlier payment deadline is disclosed and expressly accepted in your booking confirmation.
Bookings made within 60 days of departure require full payment upon confirmation unless a different payment arrangement is expressly agreed in writing.
Certain services, including nonrefundable accommodation, flights, cruises, special events, and private or group arrangements, may require earlier or additional payments. Any such requirement will be disclosed and accepted before Verity commits to the relevant services.
If payment is overdue, Verity may suspend arrangements and issue written notice allowing three calendar days to cure before cancellation. A shorter period may apply where an identified supplier deadline requires it and is disclosed in the notice.
The final-payment deadline and cancellation schedule are separate. A balance that is not yet due does not eliminate cancellation charges otherwise applicable under this agreement.
05
Payment methods and authorization
Card payments are processed through Stripe.
Card payments include a 3% processing fee. The fee is added to the amount charged on the card and is shown before you confirm. A bank transfer does not include this fee. On guaranteed weekly tours the reservation deposit is paid by card. The balance, or the full price, may be paid by card (with the 3% fee) or by bank transfer (without the fee).
Bank transfers and other approved payment methods may be requested separately, including through a Mercury invoice. Available methods and payment instructions will appear on your payment request.
You authorize only the amounts and payment schedule expressly accepted. Further card charges require a valid authorization.
Prices are in USD unless stated otherwise. Your bank or card issuer may apply foreign exchange or transfer charges. Any charge imposed by Verity will be disclosed before payment and applied only where permitted.
Do not send card details by email. Independently verify any changed bank instructions by calling Verity using its established telephone number.
06
Prices and included services
Only services expressly included in your accepted itinerary or booking confirmation are included.
Unless specified, exclusions include flights, insurance, visas and entry authorizations, gratuities, optional activities, personal expenses, additional meals, and additional accommodation.
Any proposed price adjustment after confirmation must have a disclosed contractual basis and comply with applicable law. Verity will explain the adjustment and provide any required consent or cancellation options.
An unaccepted price adjustment does not authorize an additional debit.
07
Cancellation notice
Cancellation becomes effective upon Verity’s receipt of written notice at italy@verityjourneys.com. The notice must identify the booking reference, affected travelers, and services being canceled. Verity will acknowledge receipt in writing. Cancellation does not depend on Verity approving the request or issuing its acknowledgment.
If you have not received acknowledgment within two business days, contact Verity by telephone to verify receipt.
Notice periods are measured in calendar days before departure, using the time in Palm Beach County, Florida.
Cancellation of one traveler or service does not automatically cancel the rest of a booking.
08
Traveler cancellations and refund calculation
The following default schedule applies unless a different schedule was provided and expressly accepted before purchase.
All percentages below are calculated on the total confirmed tour price per traveler, not merely the amount paid or the outstanding balance. The nonrefundable deposit is then deducted from the calculated refund. The schedule states the refund that would apply if the tour price had been paid in full.
The calculation is subject to these rules:
– Refund percentages are calculated on the total confirmed tour price per traveler, not on the amount paid or the outstanding balance.
– The cancellation charge equals the total tour price minus the scheduled refund. The nonrefundable deposit is accounted for once in this calculation. There is no separate administration fee.
– Payments already received are applied against the cancellation charge. Any excess payment is refunded. Any unpaid portion of the cancellation charge remains payable to the extent legally enforceable, as shown in an itemized invoice.
– A refund cannot be less than zero, and no cancellation charge may exceed the affected tour price, apart from separately purchased services governed by their own accepted conditions.
– Any legal requirement for a lower charge, mitigation, or proof of loss takes precedence.
These charges are intended to address booking work, commitments, and lost capacity whose precise value is difficult to determine when booking. They are not intended as a penalty.
09
Special supplier conditions and booking changes
Flights, cruises, special events, custom arrangements, and particular departures may carry different deposit, cancellation, or refund conditions.
A different condition applies only when disclosed and expressly accepted before the relevant purchase. It replaces the overlapping default condition rather than imposing duplicate charges for the same loss.
Name changes, substitutions, date changes, and room changes require approval and may constitute cancellation and rebooking. Applicable charges will be disclosed before processing.
A reduction in group size or room occupancy may change the price for remaining travelers. Any increase requires their acceptance and any alternatives required by law.
10
No-shows and unused services
Late arrival, early departure, failure to join a service, denied entry resulting from inadequate traveler documentation, or a voluntary decision not to participate generally constitutes a traveler cancellation for the affected services.
No refund is promised for voluntarily unused services except where required by law or confirmed in writing.
Services canceled or not provided by Verity are governed by the applicable cancellation or disruption provisions below and are not automatically treated as voluntarily unused.
11
Cancellation by Verity for commercial reasons
If Verity cancels an entire departure because of insufficient enrollment or another commercial reason within its control, you may accept an alternative or receive a full refund of payments made to Verity for that departure, including the deposit.
You are not required to accept a credit instead of a refund owed.
A refund of payments made to Verity is separate from reimbursement of expenses paid to others. Unless required by law or expressly agreed in writing, Verity does not reimburse independently booked flights, separate accommodation, visas, insurance premiums, lost earnings, or other external expenses.
Cancellations caused by events beyond reasonable control are addressed in section 12.
12
Force majeure and security disruptions
Verity is not responsible for failure or delay in providing services caused by events beyond its reasonable control, including war, armed conflict, terrorism, civil unrest, government restrictions, airport or border closures, natural disasters, epidemics, strikes, or major transportation disruptions.
Such events may require changes, suspension, postponement, or cancellation of travel arrangements.
If these events affect your trip, a full refund is not guaranteed. To the extent permitted by applicable law, Verity will not refund amounts paid or irrevocably committed to suppliers that cannot be recovered, or disclosed and accepted charges for planning, administration, reservations, coordination, or other services Verity has already performed.
Any refund will be limited to payments for affected, unprovided services remaining after those deductions. Uncommitted funds and supplier refunds subsequently recovered for your booking will be returned, less any applicable deductions not already accounted for. No cost will be deducted twice.
Verity will make reasonable efforts to obtain available supplier refunds but cannot guarantee recovery. Where legally permitted, the portion of a refund dependent on supplier recovery will be paid after those funds are received. A supplier credit will be identified as a credit rather than represented as a cash refund.
Verity is not responsible for independently booked flights, accommodation, insurance premiums, lost earnings, or additional accommodation, meals, transportation, evacuation, or other expenses resulting from these events, except where applicable law requires otherwise.
This section governs cancellations caused by these events; the ordinary traveler cancellation schedule will not also be applied to the same cancellation.
The deposit treatment described in section 4 applies to cancellations under this section. Any retained deposit must be credited against, rather than added again to, charges for the same work or costs.
Nothing in this section excludes a refund obligation or other liability that applicable law does not permit Verity to exclude.
13
Travel insurance
Verity strongly recommends purchasing appropriate travel insurance promptly after the first trip payment.
Consider cancellation and interruption coverage, emergency medical care, evacuation and repatriation, baggage, and travel delays.
Check territorial restrictions, travel advisories, war and terrorism exclusions, preexisting conditions, benefit limits, and purchase deadlines. Standard cancellation coverage and “cancel for any reason” benefits are different and may have different eligibility requirements.
Insurance is not included unless expressly stated.
Do not assume your policy covers war, armed conflict, terrorism, government restrictions, airport closures, or events already known when coverage is purchased. War and armed conflict may be excluded; terrorism coverage, where available, may have specific definitions, geographical limits, and eligibility conditions. Obtain confirmation directly from the insurer concerning your destination and circumstances.
Consider whether an optional Cancel For Any Reason benefit is available and suitable. Such benefits may require purchase shortly after the initial trip payment, insurance of the required trip value, cancellation before a specified deadline, and acceptance of only partial reimbursement. They do not guarantee reimbursement for every disruption or a cancellation initiated by a travel provider.
Verity is not the insurer. A recommendation or referral does not guarantee coverage, eligibility, reimbursement, or claim approval. Coverage is determined by the actual policy and insurer.
The insurance acknowledgment records that Verity recommended insurance and that the traveler made a choice. It does not establish that every loss is insurable, guarantee that a policy will respond, or release Verity from its contractual obligations or duties that cannot legally be waived.
Failure to purchase insurance does not change the cancellation policy. Insurance availability does not replace a refund or other obligation Verity owes.
14
Insurance status and follow-up
Each traveler must select one status:
– Purchased: The traveler confirms that a policy has been purchased and provides the insurer and policy details. This records the traveler’s declaration; it does not mean Verity has verified coverage.
– Not yet purchased: The traveler has not purchased coverage or has not provided confirmation. An intention to purchase insurance does not establish coverage. Until purchase is confirmed, Verity’s records will show coverage unconfirmed.
– Declined: The traveler confirms receipt of Verity’s recommendation and elects not to purchase insurance.
A traveler who later purchases coverage should provide updated details. Verity will record the updated status but does not undertake to obtain insurance, monitor policy deadlines, or guarantee policy suitability.
15
Itinerary and accommodation changes
Routes, touring order, guides, transport, hotels, and site access may change because of availability, religious holidays and Papal events, strikes, site closures, dress-code enforcement at religious sites, weather, security, or operational requirements.
Verity may make reasonable substitutions of substantially comparable standard.
Specific hotels, room configurations, accessibility features, or special requests are guaranteed only when expressly confirmed in writing.
For a material change substantially reducing the agreed program or standard, Verity will provide the notice and remedies required by applicable law.
16
Meals, transfers, and independent flights
Meal counts, included transfers, arrival arrangements, and departure arrangements are determined by the accepted itinerary and confirmation.
Dietary requests require advance notice. An absence of allergens cannot be guaranteed.
Hotel check-in, checkout, early arrival, and late departure follow the property’s rules.
Separate arrivals, changed flights, delays, or missed transfers may require additional arrangements at the traveler’s expense, except where Verity is legally responsible.
Travelers must notify Verity promptly of flight changes. The land program does not guarantee connections with independently booked flights.
17
Travel documents and taxes
Travelers are responsible for obtaining the correct passports, visas, entry authorizations, transit permissions, and parental permissions and for meeting current requirements applicable to their citizenship and itinerary.
For Italy, travelers must meet current Schengen Area entry requirements, including passport validity, any required visa, registration in the EU Entry/Exit System (EES) at the border, and any ETIAS travel authorization once required.
Entry is determined by the relevant authorities. General information supplied by Verity does not guarantee admission.
Italian municipal tourist taxes (tassa di soggiorno) and similar local charges are payable directly to the property unless the confirmation states they are included.
Travelers are responsible for charges arising from their status or failure to supply required evidence, except where law places that responsibility on Verity.
18
Health, accessibility, conduct, and minors
Travelers should review the walking, stairs, terrain, heat, transportation, and activity demands of the itinerary.
Disclose assistance and accommodation needs before booking. Verity will assess reasonable accommodations and supplier capability under applicable law.
Travelers must follow lawful safety instructions, local law, and reasonable conduct requirements.
Participation may be restricted where reasonably necessary for safety, serious disruption, unlawful conduct, or failure to meet essential requirements, consistently with applicable law.
Minors require an authorized parent or guardian’s consent and designated adult supervision. Verity does not assume parental, school, pastoral, or custodial responsibilities unless expressly agreed.
School and youth groups require a separate supervision and safeguarding arrangement.
19
Assumption of travel risks and emergency assistance
International travel involves risks including accidents, falls, illness, theft, terrorism, armed conflict, civil unrest, border closures, and delayed or unavailable medical care.
Conditions and emergency response may differ from those at home.
Travelers acknowledge the reasonably foreseeable risks described in this agreement and the itinerary and voluntarily accept the inherent risks of participation to the extent permitted by law.
This does not authorize Verity to disregard applicable duties of care.
In an emergency, travelers authorize reasonable efforts to contact their emergency contact and arrange assistance when they cannot provide instructions. This does not authorize medical decisions reserved by law to the traveler, their representative, or clinicians.
Verity does not guarantee evacuation, rescue, treatment, border access, or flight availability.
20
Express adult release of ordinary negligence claims
IMPORTANT RELEASE OF LEGAL RIGHTS — TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I, AS AN ADULT SIGNING FOR MYSELF, RELEASE VERITY JOURNEYS LLC AND ITS OWNERS, OFFICERS, DIRECTORS, AND EMPLOYEES FROM CLAIMS FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE BOOKED TRIP, INCLUDING CLAIMS CAUSED BY THEIR OWN ORDINARY NEGLIGENCE IN ARRANGING OR ADMINISTERING THE TRIP. ORDINARY NEGLIGENCE MEANS A FAILURE TO USE REASONABLE CARE. I UNDERSTAND THIS RELEASE MAY PREVENT ME FROM RECOVERING DAMAGES EVEN WHEN VERITY WAS CARELESS.
This release does not cover gross negligence, reckless or intentional misconduct, fraud, liability that cannot legally be waived, or contractual payment and refund rights.
It does not release a minor’s claims or another person’s claims that the signer lacks authority to release.
21
Limitations of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERITY WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR LOSS OF ENJOYMENT. SUBJECT TO THE EXCEPTIONS BELOW, VERITY’S AGGREGATE LIABILITY TO A TRAVELER ARISING FROM THE BOOKING IS LIMITED TO THE TOTAL AMOUNT PAID TO VERITY FOR THAT TRAVELER’S AFFECTED TRIP.
These limitations do not limit gross negligence, reckless or intentional misconduct, fraud, express refund obligations, or liability and remedies that cannot legally be limited.
They do not reduce rights concerning death or personal injury where limitation is prohibited.
22
Traveler responsibility for claims
To the extent permitted by law, travelers must reimburse Verity for reasonable losses and third-party claims directly caused by their unlawful acts, intentional misconduct, or material breach, in proportion to their legal responsibility.
This does not require indemnifying Verity for Verity’s own negligence, misconduct, or nonwaivable obligations.
Verity must provide prompt notice and a reasonable opportunity to participate in the defense of a claim. A settlement imposing liability on a traveler requires their consent, not unreasonably withheld.
23
Complaints and payment disputes
Report problems promptly so Verity has a reasonable opportunity to address them.
Send written complaints and supporting information to italy@verityjourneys.com as soon as practicable, preferably within 30 days after travel. This preferred reporting period does not shorten a statutory limitation period or extinguish legal rights.
Verity asks travelers to contact it before seeking a payment reversal where feasible. This is not a condition on exercising lawful chargeback, refund, or statutory rights.
No penalty applies merely because a traveler raises a good-faith dispute. Duplicate reimbursement for the same loss is not permitted.
Verity may provide relevant booking terms, acceptance records, payment records, and service communications when responding to a dispute.
24
Personal information and electronic records
Verity uses booking information to arrange services, communicate with travelers, maintain records, and meet legal obligations, as described in its privacy notice.
Necessary information may be shared with service providers, payment providers, authorities, and other authorized recipients, subject to applicable privacy law.
Passport and sensitive medical information should be submitted through the designated secure channel.
Where legally permitted and with any required consent, acceptance and signatures may be electronic. Travelers must be able to review and retain the agreement before accepting it.
Verity will retain the accepted version and relevant booking and authorization records.
25
Governing law and disputes
Florida law governs this agreement except where mandatory law requires otherwise.
Subject to nonwaivable jurisdiction and venue rights, proceedings must be brought in a court of competent jurisdiction in Palm Beach County, Florida, or the United States District Court for the Southern District of Florida, as applicable.
Nothing prevents a regulatory complaint, lawful payment dispute, or use of a mandatory consumer forum.
26
Mandatory rights and amendments
Nothing in this agreement waives duties, registrations, disclosures, refunds, or rights that applicable law does not permit the parties to waive.
If a provision is unenforceable, it will be severed or limited only as permitted by law, leaving the remainder effective where possible.
The version accepted for a booking remains controlling unless validly amended. Later website changes do not retroactively amend existing bookings.
